House ends with the second sentencing trial in more than 20 years

The Chamber of Deputies approved this Wednesday (14) project amending the functioning of the Court of Jury and ends with the possibility of a second trial. The project will be sent for presidential sanction.

The text approved by the Board ends with the possibility of a second trial when there is conviction for over 20 years by the Court of Jury. If sanctioned, the project enters into force in 60 days. The new regulations may influence the trial of Alexander Nardoni and Anna Jatobá Carolina, accused by the death of the girl Isabella. They should be tried by a jury of the Court.

It was this benefit which used the rancher Vitalmiro Bastos de Moura, accused of the murder of U.S. missionary Dorothy Stang. He was acquitted last week after being sentenced to 30 years imprisonment in the first trial.

The project approved in the House also reduces the duration of the process. Currently there are three hearings before trial for its examination. For the new text, there would only be a hearing, in which all the evidence be produced.

The Board also reduces the chances of postponement of the trial. With the proposal approved, the delay only happen in exceptional cases considered, and the defendant could be tried even if not comparecesse the session.
